Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and STM Web Design ("Company", "we", "us", or "our") concerning your access to and use of our website and services. By accessing or using our services, you agree that you have read, understood, and agree to be bound by these Terms.

STM Web Design provides web development, mobile app development, and related digital services. Our services include but are not limited to:

• Custom website design and development
• Mobile application development
• E-commerce solutions
• Web maintenance and support
• UI/UX design services
• Consultation services

By using our services, you agree to:

• Provide accurate and complete information when requested
• Maintain the confidentiality of any account credentials
• Notify us immediately of any unauthorized access
• Not use our services for any illegal or unauthorized purpose
• Not interfere with or disrupt our services or servers
• Respect intellectual property rights
• Comply with all applicable laws and regulations

Payment and Fees

You agree to pay all fees or charges to your account based on our pricing and payment terms. We reserve the right to:

• Change our pricing at any time with reasonable notice
• Require payment in full before commencing work
• Require deposits for larger projects
• Suspend services for non-payment

All payments are non-refundable unless otherwise specified in writing. Refund requests will be evaluated on a case-by-case basis.

Intellectual Property Rights

Our IP

Unless otherwise indicated, the services and all content, including but not limited to text, graphics, logos, images, and software, are the property of STM Web Design and are protected by copyright, trademark, and other intellectual property laws.

Client IP

Upon full payment for custom development services:

• You will own the final deliverables created specifically for your project
• We retain ownership of any pre-existing materials, templates, or tools
• We reserve the right to showcase your project in our portfolio unless otherwise agreed

Project Scope and Timeline

Project timelines are estimates and may vary based on:

• Timely provision of required materials and feedback from you
• Scope changes or additional feature requests
• Technical complexity and third-party integrations
• Unforeseen technical challenges

We will make reasonable efforts to meet agreed-upon deadlines but are not liable for delays outside our control.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• Our services will meet your specific requirements
• Our services will be uninterrupted, timely, secure, or error-free
• The results obtained from using our services will be accurate or reliable
• Any defects will be corrected within a specific timeframe

Limitation of Liability

To the fullest extent permitted by law, STM Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

Support and Maintenance

Support and maintenance terms are specified in your service agreement. Unless otherwise stated, support is provided during our business hours (Monday-Friday, 9 AM - 6 PM). Extended support or maintenance packages are available for purchase separately.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Non-payment of fees
• Illegal or fraudulent activity
• Request by law enforcement or government agencies

Upon termination, your right to use our services will immediately cease. We are not obligated to provide refunds for any unused services.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which STM Web Design operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

Entire Agreement

These Terms constitute the entire agreement between you and STM Web Design regarding your use of our services and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.
